TalkGroup Terms of Use
The short version
TalkGroup is a free app that lets nearby iPhones talk to each other directly. Be decent to people, do not use it for anything illegal, and do not rely on it in an emergency. Paid upgrades are sold and refunded by Apple. The app is provided as it is, and our responsibility to you is limited as far as the law allows.
Who we are
TalkGroup (the app and the website talkgroup.app) is made by Talk Group App, a small independent developer in the United States. In these terms, "we" and "us" mean Talk Group App, and "you" means the person using TalkGroup. You can reach us at [email protected].
Agreeing to these terms
By using the app or the website you agree to these terms and to the Privacy Policy. If you do not agree, do not use TalkGroup.
If you are under 18, or under the age of adulthood where you live, a parent or guardian needs to agree to these terms for you. TalkGroup is not directed to children under 13.
Your license to use the app
We give you a personal, non-exclusive, non-transferable license to use TalkGroup on Apple devices that you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions. You may not copy, sell, rent, or redistribute the app, or reverse engineer it except where the law allows you to. Parts of the app use open-source components under their own licenses, listed in the app.
Free features and paid upgrades
Making groups, talking, and quick signals are free. Optional upgrades are one-time in-app purchases. They are sold, charged, and refunded by Apple, under Apple's terms, not by us. We never see your payment details. See the Refund Policy. We may change what is free or paid in future versions, but we will not take away an upgrade you already bought, except where we stop offering the app entirely.
Your conduct
TalkGroup has zero tolerance for objectionable content and abusive users. When you use it, you agree not to:
- harass, threaten, bully, stalk, or intimidate anyone;
- send hateful, sexually explicit, or violent content, or anything that sexualizes minors;
- pretend to be someone else, or try to get around a block;
- use TalkGroup to break the law or to plan or carry out harm;
- share someone else's private information without permission;
- record or share other people's voices or messages without the consent the law requires where you are;
- send spam, or try to break, overload, or tamper with the app or other people's phones.
Public names and public group names are checked against a list of offensive words. Anyone can block or report another person from inside the app. Because TalkGroup has no servers, we cannot read your groups, but we review every report we receive and act on it, which can include refusing support requests such as ID resets and working with law enforcement where the law requires it.
What you send
You own what you say and type. You are responsible for it. When you send something, you let the phones in your group receive it, store it as described in the Privacy Policy, and show it to the people in that group. We do not receive it, so we cannot recover it for you.
Safety
- Not for emergencies. TalkGroup only reaches nearby phones running TalkGroup. It cannot call emergency services, and it may not work when you need it. In an emergency, call your local emergency number.
- Stay aware. Do not use TalkGroup while driving or in any way that takes your attention from something dangerous. Keep your volume at a safe level and stay aware of your surroundings.
- Location is your choice. When you send your location with a quick signal, the people in that group can see where you are. Only share it with people you trust.
- People nearby. Phones in range, including strangers, can see your public name and any public group you host. Do not use your real name if you do not want to.
Test versions
Test versions, for example through TestFlight, may have bugs and may stop working at any time. Please do not rely on them.
Our name and content
TalkGroup, the TalkGroup icon, and the website's text, images, and design belong to us. You may not use them in a way that suggests we endorse you. Press may use the icon and screenshots from the press kit to write about TalkGroup.

Changes and availability
We may update, change, or stop offering TalkGroup or any feature. We may update these terms. If we make an important change, we will update the date above and mention it in the app's release notes. Using TalkGroup after a change means you accept the new terms.
Disclaimers
TalkGroup is provided "as is" and "as available". Range, sound quality, and battery life depend on your phones and surroundings, and we do not promise that the app will always work, work without errors, or reach every member of your group. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Limits on our liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, missed messages, or anything that happens because you could not reach someone. Our total liability for any claim about TalkGroup is limited to the greater of the amount you paid for TalkGroup upgrades in the 12 months before the claim, or 50 US dollars.
Some places do not allow some of these disclaimers or limits. If you live in one of them, they apply only as far as your local law allows, and nothing in these terms takes away rights you have as a consumer that cannot be waived.
Apple App Store terms
If you got TalkGroup from Apple's App Store:
- These terms are between you and us, not Apple. We, not Apple, are solely responsible for TalkGroup and its content.
- Apple has no obligation to provide any maintenance or support for TalkGroup. Support comes from us at [email protected].
- If TalkGroup does not meet any warranty that applies, you may tell Apple, and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for TalkGroup.
- We, not Apple, are responsible for any claims about TalkGroup, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
- If someone claims that TalkGroup or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling, and discharging that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must follow the terms of any third-party service you use with TalkGroup.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple may enforce them against you.
Law and disputes
These terms are governed by the laws of the State of Wyoming and of the United States, without regard to conflict of law rules. Any dispute that is not settled informally will be heard in the state or federal courts located in Wyoming, unless the law where you live says otherwise. If you have a problem, please email [email protected] first. Most things can be sorted out that way. If you live in the European Union or the United Kingdom, you can also use the courts of the country where you live.
